Moving Within the State of New Jersey

For the most part, if you are planning on moving elsewhere within the state of New Jersey, you do not need to seek court approval nor the approval of your former spouse. However, a move from the northern end of the state to the southern end may compromise your ability to meet your child custody obligations as agreed on at the time of your divorce. If this is the case, our attorneys can help you seek a modification to your custody agreement.

Interstate Relocation and Child Custody

If you or your former spouse is seeking a move outside the state, consent from the parent who is staying is required. If consent is not granted, then the court must grant approval for the move. In order to get court approval, the parent must have a good faith reason for the move, provide a feasible parenting time arrangement and show that the child will not unduly suffer as a result of the move.

The legal team at the law firm of Carolann M. Aschoff, P.C., has extensive experience protecting the parental rights of those on either side of the issue. We are committed to helping you find a solution with a minimal emotional impact to your children.
